On August 20, law enforcement, emergency medical services, and the Marinette Fire Department responded to a distress signal at Menekaunee Harbor Boat Launch in Marinette, Wisconsin. Jakob was discovered unresponsive in the water.
According to the criminal complaint, Birch and a teenager referred to as P.C. initially asserted that Jakob had voluntarily jumped into the water with them.

However, police investigators found it peculiar that Jakob would willingly enter the water while fully clothed, as stated in the complaint.

Jakob’s mother reported that police informed her they had obtained video footage showing Jakob being pushed into the Menominee River. Birch and P.C. later confessed to having thrown him in during playful antics, despite being aware that Jakob was unable to swim.

P.C. alleged that it was Birch who suggested throwing Jakob into the water.

The complaint indicated that Jakob struggled in the water, and efforts to rescue him were futile. He was transported to Aurora Medical Center and subsequently to St. Vincent’s Hospital in Green Bay, where he passed away on August 23.

Jakob’s mother mentioned that the boys had bullied Jakob, who had a fear of deep water. The complaint highlighted that Jakob had asked Birch and P.C. if they could swim later in a different location that had shallower water.

The criminal complaint noted that a preliminary report from a Marinette County medical examiner, pending the completion of an autopsy, identified drowning as the cause of death.

Birch was taken into custody on August 21. He has been charged with second-degree reckless homicide, classified as a Class D felony, which carries a maximum sentence of 25 years in prison and/or a $100,000 fine. During a court appearance on Thursday, a judge established a cash bond of $500,000 for Birch.
