Authorities have identified the woman killed in a violent stabbing on Spencer Street as 31-year-old Abagail Perez, whose tragic death has left her family and community heartbroken.
According to the Rochester Police Department (RPD), the incident occurred on August 14 when Perez and her partner, 21-year-old Javier Justice, became involved in a heated argument that escalated to deadly violence. Investigators say Justice fatally stabbed Perez during the altercation. A bystander, witnessing the attack, intervened and shot Justice in an effort to stop the stabbing.
Perez was rushed to the hospital but later succumbed to her injuries. Justice, who survived the shooting, remains hospitalized and is expected to recover. Police confirmed he will face second-degree murder charges and will be arraigned once his medical condition allows.
This was not Justice’s first encounter with the law involving Perez. Just last month, he was arrested for allegedly assaulting her, obstructing her breathing, and stealing her phone. He was released on his own recognizance. In addition, he faces a pending indictment for criminal possession of a weapon linked to a 2023 shooting.
Authorities have not charged the bystander who shot Justice, noting their actions appeared to be in defense of Perez.
The case has drawn sharp attention to the ongoing dangers of domestic violence, raising questions about whether earlier intervention could have prevented Perez’s death. Community advocates have called for stronger protections and resources for victims of abuse.
As Perez’s family grieves the loss of a beloved mother, daughter, and friend, investigators continue to pursue justice in the case. Prosecutors are expected to move forward with the murder charge against Justice, alongside his other pending cases.
